Terms of Use
These terms govern your use of the Presence DPC Patient and Presence DPC Physician apps and related services (the “Services”) provided by Presence Direct Primary Care PLLC (“Presence DPC”, “we”, “us”). By creating an account or using the Services you agree to them.
Telemedicine
- Care is provided by physicians licensed in the state where you are located at the time of your visit.
- Telemedicine has limits. Your physician may decide your concern needs an in-person exam, tests, or care elsewhere.
- A visit does not guarantee a diagnosis, a prescription, or any particular treatment. Prescribing is at the physician's professional judgment.
- Our physicians do not replace emergency services or your other healthcare providers.
Eligibility and your account
- You must be 18 or older and located in the United States.
- You must give accurate, complete and current information, including your health history, and keep it up to date. Your care depends on it.
- Keep your sign-in details private. You are responsible for activity on your account.
Fees and payment
- The fee for a visit is shown before you pay. Payments are processed by Stripe.
- A premium subscription renews monthly and is charged each month until you cancel. You can cancel in the app (Profile → manage subscription). Cancelling stops future renewals; your premium benefits continue until the end of the period you have paid for.
- For refund questions, contact us. Refunds are handled under the practice's policy.
Acceptable use
You agree not to:
- use the Services for anyone other than yourself, or impersonate anyone;
- send content that is unlawful, abusive, harassing or unrelated to your care;
- try to access other people's data, disrupt the Services, or reverse engineer them;
- use the Services for any unlawful purpose.
Ending your account
You can delete your account at any time (how). We may suspend or close an account that breaks these terms, is used abusively, or where continuing care is not medically or legally appropriate. Where we close an account, we will help you obtain your medical records.

Disclaimers
The Services are provided “as is” and “as available”. Apart from the professional medical care provided by our physicians, we do not warrant that the Services will be uninterrupted, error-free, or always available. Information in the app is not a substitute for a consultation with your physician.
Limitation of liability
To the fullest extent permitted by law, Presence DPC is not liable for indirect, incidental, special or consequential damages arising from use of the Services, and our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules.
Changes
We may update these terms. We will update the date above and, for significant changes, tell you in the app or by email. Continuing to use the Services means you accept the updated terms.
